The mobile game “Dream Cricket” (“Game”) is carried on under the brand name of Dream Game Studios (“DGS”) which is owned and operated by Sporta Technologies Private Limited (“Sporta”), a company incorporated under the laws of India and having its registered office at Unit No.1201-1202, 12th Floor, Wing A, One BKC, G Block, Plot No.66, Bandra Kurla Complex, Bandra-E Mumbai, Mumbai City, Maharashtra-400051, India.

Through this Game, Sporta is offering on a free-to-play basis, game play in an offline and online mode . The User participating in the offline mode of the Match shall compete with the computer/artificial intelligence by playing in matches of leagues/tournaments/competitions that are currently taking place. Based on the User’s performance and progress, the User may be entitled to unlock rewards, in the form of player cards, which may be used in the creation of the User’s ‘dream team’. The online mode of the Match shall follow a multi-player format permitting the User to compete with other users and accordingly win trophies and/or unlock rewards to create/develop their ‘dream team’.

For the purpose of this Privacy Policy (“Privacy”), wherever the context so requires "You", “Your”, “Yourself”, “Their” or “User” shall mean any person who accesses or uses the Game. “We”, “Us” or “Our” shall mean Sporta, its employees, and authorised agents that perform any services on Sporta’s behalf in relation to the Game.

We have utmost respect for Your privacy. This Privacy Policy (“Policy”) reflects Our commitment towards protecting the privacy and personal information provided by You and sets out the nature and type of information We collect from You for the purposes outlined in this Policy, the usage and disclosure of such information, and the safety and security measures adopted by Us to safeguard such information.

Please note that this Policy is specifically applicable to the Users and the information and data gathered on or through the Game and not to any other information or website.     Information that We collect from You at the time of registration as indicated under the Terms or at any other time will vary depending upon the activity You seek to engage in. You may add or update certain information, in which case We may keep a copy of the prior version for Our records.

    The Game or any part thereof may utilise data collection tools such as “cookies” and other tracking technologies. A “cookie” is a small text file that may be used, for example, to collect information about Your activity on the Game. Some cookies and/or other technologies We use may serve to save and/or recall information previously indicated/provided by You on the Game. If You choose to eliminate cookies, the full functionality of the Game may be impaired for You.

    Our use of cookies and other tracking technologies allows Us to improve the Game, tailor the Game and its usability to Your interests, remember choices You make (such as User/Account name, email address, any information that You provide for/while accessing the Game etc.), deliver content that is most relevant to You and Your interests, and improve and enhance Your experience using the Game. We may also analyse information that does not include information for measuring traffic, User activity on the Game, trends and statistics.

    4 PERSONAL INFORMATION

    Personal Information means any information that may be used solely or in combination with each other to identify You and that is not otherwise publicly available, including, but not limited to, Your first and last name, gender, age, place of residence, email address, phone number or other contact information (“Personal Information”).

    We may collect Personal Information from You when You register and create a profile on the Game to participate in the Game, or otherwise voluntarily provide such information. Further, in the case of Users participating in the Game, We may use such Personal Information to verify Your credentials.

In certain circumstances, We may share aggregated non-personal information with third parties.     The information as provided by You and the data concerning usage of the Game, including without limitation Your Personal Information and demographic information, shall be shared by Sporta with its affiliates to keep you informed of their offerings or with third party service providers engaged by Sporta, for the purpose of data analytics, for the purpose of storage, improving the services as well as such other purposes as may be notified to you, at the time of collection of data, from time to time, provided that the entity with which the information is shared will be required, on best efforts basis, to comply with the same standards as applicable to Sporta. By using the Game, You agree to the above, and accord Your explicit consent in respect of the disclosure, transfer, and usage of data as relates to You. In the event Sporta sells or transfers all or a portion of its business assets, or merges with or is acquired by another entity, Personal Information may be shared, disclosed or transferred as part of the transaction, provided that the entity with which the information is shared or the combined new entity (in the case of a merger) will be required, on best efforts basis, to comply with the same standards as applicable to Sporta.

    You hereby expressly grant consent and permission to Sporta for disclosure and transfer of Your Personal Information to such third parties. Further, We reserve the right to disclose Personal Information as obligated by law, in response to duly authorized legal process, governmental requests and as necessary to protect Our rights and interests.

    Where We propose to use Your Personal Information for any other uses, We will ensure that We notify You first. You will also be given the opportunity to withhold or withdraw Your consent for the use of Your Personal Information, other than as listed above or elsewhere in this Policy.     Sensitive Personal Information (“SPI”) means such personal information which consists of information relating to Your biometric information, sexual orientation and financial information (such as bank account details or credit card numbers) and such other information specified as constituting SPI under the applicable laws of India.

    Except for any SPI that You choose to provide as part of Your profile or in the course of transacting on the Game, We do not collect any SPI in the course of providing You services. Any SPI collected by Us shall not be disclosed to any third party without Your express consent, save as otherwise set out in this Policy or the Terms or as provided in a separate written agreement between Sporta and You or as required by law. It is clarified that this condition shall not apply to publicly available information, including SPI, in relation to You on the Game.

    However, You acknowledge that in the course of Your participation in the Game, We may receive SPI, either when You voluntarily choose to update Your profile with information related to Your identity, physical and physiological condition, or from such content posted by You on the Game, and You hereby consent and agree to allow Us to store and display the SPI collected in this manner on the Game and disclose it in accordance with the terms of this Policy.

    It is clarified that with respect to any SPI that You may share with Us , You have the sole right to determine whether You want to share such information with Us. Further, with respect to any SPI that You may share in the course of updating Your profile, You have the right to determine the levels of access to such information, by adjusting the privacy settings of Your account with the Game.

    7. CONFIDENTIALITY AND SECURITY

    The security of Your Personal Information is important to Us. We have implemented security policies, rules and technical measures, as required under applicable law including firewalls, transport layer security and other physical and electronic security measures to protect the Personal Information that is under Our control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss.

    12. TERMINATION OF USER ACCOUNT

    In the event that You choose to terminate and delete Your Account with Us in respect of the Game, or if Your Account has been terminated for any other reason, such as a violation of the Terms, Your Personal Information may be retained and may continue to be used until: (i) the relevant purposes for the use of Your information described in this Policy are no longer applicable; and (ii) We are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain Your Personal Information and the retention of Your Personal Information is not required for the establishment, exercise or defense of any legal claim.

    The invalidity or unenforceability of any provision of this Policy, in whole or in part, in any jurisdiction shall not affect the validity, legality or enforceability of the remainder of this Policy in such jurisdiction and this Policy shall continue to operate to its fullest extent, permissible under law.

    16. APPLICABLE LAW

    This Policy and information contained herein, shall be governed by the laws of the Republic of India without regard to conflict of law principles and any dispute arising in respect hereof shall be governed by the dispute resolution process set out under the Terms.
